Information We Collect

We collect the following types of information:

• Account Information: Email address and other details provided during registration, including hashed password (bcrypt).
• Usage and Interaction Data: Details about how you interact with the Platform, such as features used, AI-generated insights, conversation transcripts, audio recordings, AI summaries, and advertising or marketing engagement data (e.g., ad interactions tracked via Meta Pixel, email open and click data tracked via Klaviyo).
• Communication Data: With consent, phone numbers or other contact information for SMS/text message follow-ups, check-ins, or progress tracking.
• Usage Metadata: Timestamps, duration, device type, feature usage.
• Device and Technical Data: IP address, browser type, device information, and usage logs.
• Payment-Related Data: Information processed through Stripe for payments (we do not store full payment details).
• Optional Inputs: Questionnaire or assessment responses you choose to provide.

We use certain third-party cookies and tracking technologies on the Platform, including Meta Pixel (for advertising and analytics) and Klaviyo (for email marketing). These tools may collect information about your activity on the Platform and, in the case of Meta Pixel, may link that activity to your broader online profile. Local storage is also used for session state and preferences. We honor Global Privacy Control (GPC) signals where required by applicable law. You may opt out of advertising-related tracking through your browser settings, our cookie preference center, or by submitting a request to privacy@askserge.ai.

We do not collect advertising identifiers, precise location, or unnecessary personal details.

How We Use Your Information

We use your information on the basis of your consent, our contract with you, and our legitimate business interests to:

• Operate and provide the Platform, including AI-powered intake, personalized wellness plans, pre-prepped responses, automated check-ins, and progress tracking.
• Process limited sensitive personal information—specifically voice recordings and emotional analysis—solely to deliver coaching experiences. This data is not used for profiling or automated decision-making beyond generating real-time conversational responses.
• Process payments.
• Send follow-up communications.
• Improve the Platform.
• Ensure security of the Platform.
• Fulfill legal obligations.

AI responses are generated contextually and are not used to make legally or medically binding decisions. No employment, credit, or insurance determinations are made using your data.

Data Protection

• In Transit: Encrypted via TLS 1.2+ / HTTPS.
• At Rest: Encrypted within Supabase PostgreSQL.
• Voice Streams: End-to-end encrypted through ElevenLabs.
• Access Controls: Row-Level Security (RLS) and role-based permissions.
• Audit Logs: Administrative actions recorded for review.

If unauthorized access, disclosure, or loss of data occurs, we will notify affected users and regulators as required by applicable law. Data is stored and processed in the United States.

Sharing and Disclosure of Your Information

We do not sell your information. We may share your information with trusted third-party service providers (such as those listed in Section 7) who assist us in operating the Platform, subject to confidentiality obligations. We may also disclose information if required by law, or to protect the rights, safety, or property of SERGE AI, LLC.

Communications and Consent

With your explicit consent, we may send email and/or SMS/text messages for follow-ups, reminders, or Platform-related communications. Standard messaging rates may apply. You can withdraw consent or opt out at any time via Platform settings or by contacting us.

Your Rights and Choices

Subject to applicable laws:

• You may request access to, correction of, or deletion of your personal information (subject to exceptions, such as legal retention requirements) and request categories of information collected in the last 6 months.
• You may opt out of marketing communications.
• For California residents under CCPA/CPRA: You have the right to know what personal information is collected, to delete it, to correct inaccuracies, to limit the use of sensitive personal information, and to opt out of sales or sharing of your personal information for cross-context behavioral advertising purposes (we do not sell data for monetary consideration, but we do share certain data with advertising partners as described herein).

Requests can be submitted to privacy@askserge.ai. We may verify your identity before responding. We will respond within 45 days of receipt of a verifiable request, or notify you if an extension is required.

Third-Party Services

The Platform integrates with third-party service providers. All subprocessors are contractually required to maintain equivalent security controls; however, we are not responsible for their privacy practices beyond those contractual obligations. Changes to This Privacy Policy

We may update this Privacy Policy. Changes will be posted on our website or within the Platform, with the updated “Last Updated” date. For material changes to how we process sensitive personal information, we will seek your affirmative consent. Continued use after non-material changes constitutes acceptance of those changes.
